Get My Free Claim ReviewCo-op and Condo Claims: Working Out Whose Policy Pays
A leak in a New York co-op or condo is rarely one claim. There is a building policy held by the corporation or association, and there are individual unit-owner policies underneath it. Where the building policy stops and yours begins is set by the proprietary lease, the bylaws and the offering plan: documents most owners have never read, and carriers read closely.
That gap is where people lose money. The managing agent tells you it is your policy. Your carrier tells you it is the building. Nobody moves, and the unit stays unlivable. We read the governing documents alongside both policies, establish which loss elements sit on which side of the line, and put a documented position in writing so the claim stops going in circles. Where the building is genuinely responsible, we say so and pursue it there.
We also represent boards directly on building-wide losses: roof failures, facade damage, mechanical and elevator losses, and claims that follow Local Law 11 work.
Water Damage in Pre-War Buildings
The single most common large loss we see in the city is a riser or supply line letting go in an older building. It never damages one apartment. It travels down the line, and by the time it is discovered you have four or five units affected, wet insulation inside the wall assembly, and a building that wants everything dried and closed up as quickly as possible.
The pressure to reopen the wall works directly against the claim. Once it is sealed, the evidence of how far the water travelled is gone, and the carrier scopes the repair off what is visible. We get moisture mapping and thermal readings on record before drying starts, and we scope the concealed damage while it can still be proved.

New York City Questions We Get Asked
Water came from the apartment above mine. Do I claim, or does the building?
It depends on what was damaged and what your building documents say. Broadly, the building policy tends to cover the structure and original installations, while your policy covers your contents and improvements you or a previous owner made to the unit. The line between them is set by the proprietary lease or bylaws, not by the managing agent. Send us the documents and the policies and we will map it out.
Can a co-op or condo board hire a public adjuster?
Yes. Boards regularly retain public adjusters on building-wide losses, and it is often the point at which a stalled claim starts moving. We can represent the corporation or association directly, and we work alongside your managing agent and counsel rather than around them.
Is a public adjuster the same as the adjuster my insurance company sent?
No, and this is the distinction that matters most. The adjuster the carrier sends works for the carrier. A public adjuster is licensed to represent you, the policyholder. K9 holds New York Licence No. PA-1834424 and we only ever work on the policyholder side.
How long do I have to file a property claim in New York?
Your policy sets the deadlines, and they vary: there is usually a requirement to give prompt notice and a separate contractual limitation period for legal action. Check your policy and act early rather than assuming you have time. If you are unsure where you stand, call us and we will look at the dates with you.
